1. Definitions

In these general terms and conditions, the following definitions apply:

• Contractor: Sagradov Bouw, KvK: 89106067, BTW: NL004690130B05
• Client: any natural or legal person who enters into an agreement with the Contractor
• Agreement: the contract for construction, renovation, installation or other services

2. Applicability

These general terms and conditions apply to all offers, quotations, and agreements of Sagradov Bouw, registered at the Netherlands Chamber of Commerce (KvK) under number 89106067. Deviations are only valid if agreed in writing.

3. Quotations and Offers

All quotations are non-binding and valid for 30 days, unless stated otherwise. Quotations do not automatically apply to future orders. Prices are exclusive of VAT (BTW) at the applicable rate, unless explicitly stated otherwise.

4. Execution of Work

The Contractor will carry out the work to the best of their ability and in accordance with the standards of good workmanship (goed en deugdelijk werk). Delivery periods are indicative and not deadlines (geen fatale termijnen), unless explicitly agreed otherwise in writing. The Contractor uses quality materials and may engage qualified subcontractors.

5. Obligations of the Client

The Client must ensure:

• Timely access to the work location
• Necessary permits and approvals are obtained
• Accurate and complete information is provided
• Adequate facilities (water, electricity) are available at the work site

6. Additional Work (Meerwerk)

Work that falls outside the agreed quotation shall be considered additional work. The Contractor shall inform the Client of additional costs before executing such work. Additional work will be charged at the agreed rates or, in absence thereof, at reasonable rates.

7. Payment

Payment is due within 14 days of the invoice date, unless otherwise agreed in writing. Payment shall be made to bank account: NL04INGB 0101448562. In the event of late payment, the Client owes statutory commercial interest (wettelijke handelsrente) as per Article 6:119a of the Dutch Civil Code (Burgerlijk Wetboek).

8. Warranty

The Contractor provides a warranty on completed work as specified per project. The standard warranty period is 6 months after completion, unless otherwise agreed. Defects must be reported in writing within 14 days of discovery. The warranty does not cover damage resulting from improper use by the Client or normal wear and tear.

9. Liability

The Contractor's liability is limited to direct damages and shall in no event exceed the amount paid out by the Contractor's professional liability insurance (beroepsaansprakelijkheidsverzekering). The Contractor is not liable for indirect damages, consequential damages, loss of profit, or business interruption.

10. Force Majeure (Overmacht)

The Contractor shall not be liable for non-performance due to force majeure, including but not limited to: extreme weather conditions, supply chain disruptions, government measures, pandemics, and labour shortages. During force majeure, obligations are suspended.

11. Cancellation

If the Client cancels an agreement, costs already incurred and materials ordered shall be charged. In addition, a cancellation fee of 10% of the total agreed price may apply, unless otherwise agreed in writing.

12. Applicable Law and Disputes

These terms and all agreements are governed exclusively by Dutch law. Disputes shall be submitted to the competent court in The Hague (Rechtbank Den Haag), unless the law prescribes otherwise.
